IN THE MATTER OF THE RACING COMMISSION ACT S.O. 2000, c.20;
AND IN THE MATTER OF THE APPEAL AND REQUEST FOR HEARING BY
THOROUGHBRED LICENSEE KRISTA M. CARIGNAN
On August 22, 2011, the Stewards issued Thoroughbred Official Ruling TB 7224 wherein Jockey Krista M. Carignan (“CARIGNAN”) was given the penalty of one racing day August 28, 2011, for verbally and physically assaulting another licensee in the Jockey’s Quarters following the running of the eighth race on August 22, 2011, at Fort Erie Racetrack, in violation of Thoroughbred Rules 16.05(a) & (b)
On August 29, 2011, CARIGNAN filed a Notice of Appeal, pursuant to Rule 13.17(b) of the Rules of Thoroughbred of Racing.
On October 6, 2011, a Panel of the Ontario Racing Commission (“ORC”), comprised of Commission Chair Rod Seiling, convened for the purpose of hearing this matter.
Gunnar Lindberg appeared on behalf of the Administration of the ORC. Robert King of the Jockey’s Benefit Association represented CARIGNAN who was not present.
Mr. King made a motion on behalf of CARIGNAN to drop the appeal which was granted by the Panel at no cost to CARIGNAN.
CARIGNAN is hereby suspended one racing day, October 23, 2011 and fined $500.00 payable on or before October 30, 2011.

MR. CHAIRMAN: All rise. Please be seated. Now I understand before we start we have got two matters Ms. Pinto and Ms. Villeneuve but I understand we have got another one regarding Ms. Carignan we need to deal with in advance and we will get it out of the way.
MR. KING: Yes.
MR. CHAIRMAN: Why don't you.
MR. KING: As a friend of the court Ms. Carignan has asked me to represent her as her agent and she wishes to drop her appeal.
MR. CHAIRMAN: So just for the record, do you want to introduce yourself.
MR. KING: Robert King, National Manager of the Jockey's Benefits Association.
MR. CHAIRMAN: And it is for Krista Carignan?
MR. KING: Krista Carignan, yes.
MR. CHAIRMAN: Okay. Given, and I have checked but given that the Administration has not proceeded in doing any work on this and has not expended any time or costs we will allow the appeal to be dropped with no costs.
MR. KING: Thank you.
MR. CHAIRMAN: Okay.
