COMMISSION HEARING TORONTO, ONTARIO – DECEMBER 7, 2011
IN THE MATTER OF THE RACING COMMISSION ACT, S.O. 2000, c.20;
AND IN THE MATTER OF THE APPEAL AND REQUEST FOR HEARING BY THOROUGHBRED LICENSEE JACKLYNN WYATT
On October 13, 2011, the Stewards issued Thoroughbred Official Ruling TB 7340 wherein Jacklynn Wyatt (“Wyatt“) was denied an extension of her Apprentice Certificate as it had expired, having exhausted the three-year time limit as per TB Rules 30.03 and 30.18.
On November 6, 2011, Wyatt filed a Notice of Appeal, pursuant to Rule 13.17(b) of the Rules of Thoroughbred Racing.
On December 7, 2011, a Panel of the Ontario Racing Commission (“ORC”), comprised of Commissioner John Macdonald, convened for the purpose of hearing this matter.
Neil McCoag appeared on behalf of the Administration of the ORC. Wyatt attended the Hearing and was represented by Robert King, Jr.
After reviewing the evidence, hearing the testimony of Steward Richard Grubb, and Wyatt, and upon considering the closing submissions, the Panel allowed the appeal.
Ms. Wyatt is allowed a medical extension of her Apprentice Jockey Certificate for a period of one calendar year 2012.

MR. CHAIRMAN: It's actually amending the rules here but the extenuating circumstances are such here that we do have a duty to allow people to continue in their chosen profession and I would think that the extenuating circumstances are such here that she should be permitted to have an extension of her apprentice licence for the calendar year 2012. Any further questions, gentlemen?
MR. MCCOAG: Just so I understand it, we are allowing her to have the extension for the calendar year 2012?
