COMMISSION HEARING TORONTO, ONTARIO – SEPTEMBER 29, 2010
IN THE MATTER OF THE RACING COMMISSION ACT S.O. 2000, c.20;
AND IN THE MATTER OF THE APPEAL AND REQUEST FOR HEARING BY THOROUGHBRED LICENSEE MELANIE PINTO
On August 3, 2010, the Stewards issued Thoroughbred Official Ruling TB 6667/10 wherein Melanie Pinto (“Pinto”), was given the penalty of a three racing day suspension and fined the sum of $500.00 for violation of Directive 4-2009, Rules 9.27.07(a) and 9.27.08(a) & (b) of the Rules of Thoroughbred Racing.
Pinto was penalized for raising her hand above the shoulder while urging her mount, “Avoid the Rush” during the running of the first race on August 2, 2010, at Fort Erie Racetrack. This was a third offence for Pinto within a one-year period of her first offence.
On August 3, 2010, Pinto filed a Notice of Appeal, pursuant to Rule 13.17.02 of the Rules of Thoroughbred Racing.
On September 29, 2010, a Panel of the ORC, comprised of Commissioner John Macdonald convened for the purpose of hearing this matter.
Due to time constraints, all parties agreed to an adjournment and reschedule for November 10, 2010.
