COMMISSION HEARING TORONTO, ONTARIO – JUNE 9, 2010
IN THE MATTER OF THE RACING COMMISSION ACT S.O. 2000, c.20;
AND IN THE MATTER OF THE APPEAL AND REQUEST FOR HEARING BY
THOROUGHBRED JOCKEY ANATRAM SUNNY SINGH
On May 11, 2010, the Stewards issued Thoroughbred Ruling TB 6407/10 wherein Anantram Sunny Singh (“SINGH”) was fined $300 and suspended from riding for one racing day (May 16, 2010) for violation of Thoroughbred Rules 9.27.05 (b), 9.27.08 (a) and (b) (second offence).
On May 11, 2010, the Stewards issued Thoroughbred Ruling TB 6412/10 wherein Singh was fined $500 and suspended from riding for three racing days, (May 17, 18 and 23, 2010) for violation of Thoroughbred rules 9.27.05 (b), 9.27.08 (a) and (b) (third urging offence within a calendar year).
On June 9, 2010, a Panel of the Ontario Racing Commission (“ORC”), comprised of Commissioner John Macdonald, as Chair, convened for the purpose of hearing this matter.
William McMahon appeared on behalf of the Administration of the ORC. Singh attended the Hearing and was represented by Robert King, Secretary of the Jockeys’ Benefit Association.
An Agreed Statement of Facts and a Joint Submission were submitted to the Panel for consideration.
The Chairman accepted the Joint Submission on behalf of the Racing Commission and Mr. King on behalf of Mr. Singh and will be reflected in the order that is made in that regard.
i. Singh shall pay his outstanding fines in the amount of $800 on or before June16, 2010.
ii. The one-day riding suspension as ordered in TB 6407/10 shall be stayed.
iii. The three-day riding suspension as ordered in TB 6412/10 shall also be stayed.
iv. Singh shall be placed on probation from June 9, 2010-May 2, 2011, inclusive, upon the following conditions:
a. Should Singh commit any urging violation while on probation, he shall be immediately suspended from riding for four days, and
b. Singh shall be referred to the Director for further penalty including fine and/or suspension.
