COMMISSION HEARING TORONTO, ONTARIO – OCTOBER 13, 2009
IN THE MATTER OF THE RACING COMMISSION ACT, S.O. 2000, c.20;
AND IN THE MATTER OF THE APPEAL AND REQUEST FOR HEARING OF
STANDARDBRED LICENSEE WILLIAM ELLIOTT
On April 25, 2008, the Executive Director of the Ontario Racing Commission (“ORC”) issued an Order of Immediate Suspension to ORC licensee, William Elliott (“Elliott”).
On May 6, 2008, Elliott, through his Counsel, filed a Notice of Appeal of the Order of Immediate Suspension.
On June 5, 2008, the Executive Director of the ORC issued a Notice of Proposed Order to Suspend the licence of Elliott for 10 years with a fine of $40,000.
On June 25, 2008, Elliott, through his Counsel, filed a Notice of Appeal of the Notice of Proposed Order to Suspend the licence of Elliott for 10 years with a fine of $40,000.
On September 15 & 16, 2009, a Panel of the ORC consisting of Chair Rod Seiling, Vice-Chair James Donnelly and Commissioner Bernard F. Brennan, DVM, was convened to hear this matter.
Larry Todd appeared as Counsel for Elliott. Brendan Van Niejenhuis appeared as Counsel for the Administration.
Upon carefully considering the testimony, evidence and submissions, the Panel denies the appeal and orders the following:
i. The order of suspension of Elliott for ten (10) years is confirmed;
ii. The fine payable by Elliott is varied and set at $60,000.
