COMMISSION HEARING TORONTO, ONTARIO – October 29, 2009
IN THE MATTER OF THE RACING COMMISSION ACT, S.O. 2000, c.20;
AND IN THE MATTER OF THE APPEAL AND REQUEST FOR HEARING OF
THOROUGHBRED LICENSEE TERANCE JORDAN
REGARDING THE HORSE HOLLYWOOD HIT
On October 9, 2009, the Stewards issued Ruling Number TB 6203/09 wherein the horse, Hollywood Hit, trained by Terance Jordan (“Jordan”), was rendered ineligible to enter or race in Ontario for ninety days as a consequence of a positive test for the class III drug, acepromazine.
On October 16, 2009, Dan McMahon, counsel on behalf of Jordan (“McMahon”), requested a stay of Ruling Number TB 6203/09.
On October 19, 2009, the Executive Director of the Ontario Racing Commission (“ORC”) issued Ruling Number TB ADMIN 24/2009 wherein he denied Jordan’s request for a stay.
On October 19, 2009, McMahon appealed Ruling Number TB ADMIN 24/2009 on behalf of Jordan.
On October 29, 2009, a Panel of the Ontario Racing Commission, comprised of Chair Rod Seiling, was convened to hear the Appeal.
Jennifer Friedman appeared as counsel for the Administration. McMahon represented Jordan.
Upon reviewing the Joint Book of Documents and upon hearing the arguments and submissions of counsel, the Panel denied the appeal with written reasons to follow.
