COMMISSION HEARING TORONTO, ONTARIO – JUNE 2, 2009

IN THE MATTER OF THE RACING COMMISSION ACT S.O. 2000, c.20;

AND IN THE MATTER IN THE APPEAL OF

STANDARDBRED LICENSEE EVZEN PINDUR

Evzen Pindur, (“Pindur”), is licensed with the Ontario Racing Commission (“Commission”) as a standardbred driver, trainer, owner, authorized agent, Licence No P31455.

On April 23, 2008, the Executive Director of the Commission issued a Notice of Proposed Order for the suspension of the licence of Pindur and the imposition of a fine and also made an Order of Immediate Suspension of the licence of Pindur (pursuant to Sections 22 and 23 of the Racing Commission Act).

On June 2, 2009, a Panel of the Commission, consisting of the Chair, Rod Seiling, was convened to hear these matters.

Pindur was represented by Howard Cohen as counsel. Anthony Williams appeared as counsel for the Administration.

The request for an adjournment by the licensee was granted on consent.

The hearing is now scheduled for November 2, 3, and 4, 2009, commencing at 9:00 a.m.
