LICENSEE TERRANCE RYAN
Terrance Ryan requested a hearing before the Ontario Racing Commission of the Director’s Notice of Proposed Order to Refuse a Licence issued on June 13, 2007.
On September 24, 2007, a Panel of the Ontario Racing Commission consisting of Chair Rod Seiling and Commissioners George Kelly and David Gorman convened to hear the matter.
Martha Cook appeared at the hearing for the Administration and Terrance Ryan appeared on his own behalf.
On hearing the evidence and on reading and reviewing the exhibits filed, and on hearing the submissions of counsel and Mr. Ryan, the Commission determined pursuant to its powers under section 22(6)(a) of the Ontario Racing Commission Act that it should affirm the Director’s proposed Order to refuse to issue a thoroughbred licence to Mr. Ryan.
The Panel gave oral reasons for decision which form part of the transcript and is attached to this ruling.

MR. MCKINNEY: All rise. This hearing before the Commission is now in session.
MR. CHAIRMAN: Please be seated. In the matter of Terrance Ryan's appeal to quash the Director's decision to refuse to grant him an ORC license the appeal fails. Contrary to Mr. Ryan's evidence and belief an ORC license is a privilege, not a right. The Director, given the evidence before him had no other choice but to refuse Mr. Ryan's license application.
Mr. Ryan, once his current difficulties both with the pending criminal charges and with pending financial obligations are cleared up, can reapply for an ORC license as per the Rules of Thoroughbred Racing. The panel sincerely hopes that Mr. Ryan can redeem his life and conquer his alcoholism. At the end of the two year period he will have to demonstrate to the Director's satisfaction that he acts and will act in accordance with the law, with integrity, honesty and in the public interest.
His letters of support are a good start but hardly indicative of future conduct given the short time frame the authors of the letters have known him except that for his father. This hearing is adjourned.
