THOROUGHBRED LICENSEE ANATRAM SINGH
Thoroughbred licensee Anatram Singh ("Mr. Singh") appealed a decision imposed by the Ontario Racing Commission in Ruling TB 4656/2006 for violation of Rules 15.26.03 (a), (b) and (c) of the Rules of Thoroughbred Racing.
On March 23, 2007 a panel of the Ontario Racing Commission consisting of Chair Rod Seiling, Commissioners David Gorman and Bernard Brennan, DVM convened to hear the matter.
Luisa Ritacca appeared at the hearing for the Administration and Shale Wagman appeared on behalf of Mr. Singh.
On hearing the evidence of Mr. Singh, Ricardo Ramrattan and Kimberly Damiani and on reading the exhibits filed and on hearing the submissions of the parties, the Commission ordered as follows:
Mr. Singh's appeal is denied.
Mr. Singh, in recognition of his rehabilitation progress, be allowed to obtain an ORC licence as a groom, hot walker or exercise rider so as to enable him to find employment that, the panel was told, is an important component of his rehabilitation.
Upon conclusion of his suspension, Mr. Singh shall be placed on probation for a period of one (1) year and, during the term of the probation the following conditions will apply:
a. He shall present himself for testing to the ORC Drug Testing Unit each time it is at a track where he is racing or programmed to race;
b. He shall abstain from the use of alcohol or all controlled substances other than prescribed medication in accordance with the prescription and provide a written undertaking to the Director of Racing, Ontario Racing Commission, to do so;
c. He shall continue to attend and actively participate in his recovery support programs with the Halton Recovery Home and his church elders;
d. If, during the period of his probation he shall be found to be in violation of any drug or alcohol related rules of Thoroughbred Racing, then Mr. Singh can expect that this Commission will look at ways to suspend him from the privilege of an ORC licence for an indefinite period of time.

Reasons
4This Commission takes a very dim view of the use of illegal and or illicit drugs and medications in the horse racing industry be they for human or animal usage.
5Our concern is centred on the safety for those who participate in the industry, the health and safety of the horse, the health and safety of the individual and the integrity of the industry.
6Abuse of drugs and medications is a societal problem and this Commission has already clearly defined policies that are designed to act as a detriment but also assist those who clearly have recognized their problem and are ready to change.
7We are pleased to see that Mr. Singh has apparently taken the time to get his life in order as it relates to his drug and alcohol problems. We also note that this not a first offence for the appellant and caution him that we will not tolerate any further violations without serious consequences.
8This panel, while it accept the recommendation of the Administration and supports the guideline as it relates to the penalty, it also is moved by the sincerity of Mr. Singh to regain control of his life. It therefore wants to assist in his rehabilitation by facilitating a limited return to work process.
