STANDARDBRED LICENSEE SIMON ALLARD
Standardbred licensee Simon Allard appealed his suspension for one year and fine of $10,000 as a result of a positive test for the class III substance HEPTAMINOL, imposed by Judges' Ruling SB 33286 on December 20, 2005.
On March 22, 2006 a Panel of the Commission consisting of Chair Lynda Tanaka and Commissioners Jane Garthson and Bernard Brennan, D.V.M., convened to hear the appeal. Brendan Van Niejenhuis represented the Administration. The Panel convened at 10:00 a.m. in accordance with the Notice of Hearing.
Mr. Allard did not attend at the commencement of the hearing. The Panel adjourned until 10:35 a.m. and resumed the hearing.
On resuming the hearing, and neither Mr. Allard nor his counsel being in attendance, the Administration moved to dismiss the appeal. On hearing the submissions of counsel for the Administration, and on reading Exhibit 1, filed, including the Pre-Hearing Conference Report, and on reading Exhibit 2, filed, being the Acknowledgment of Service of the Notice of Hearing personally on Mr. Allard as of February 5, 2006, the Panel ordered that the appeal be dismissed as abandoned.
