STANDARDBRED LICENSEE JEFF BARKLEY
Standardbred licensee Jeff Barkley was required to appear before the Commission for a second positive test for the controlled substance cocaine within twenty-four months pursuant to Rule 6.38.05(iii) of the Rules of Standardbred Racing. Jeff Barkley also filed a Notice of Appeal dated March 17, 2006.
On March 22, 2006, a Panel of the Commission consisting of Chair Lynda Tanaka and Commissioners Jane Garthson and Bernard Brennan, D.V.M., convened to conduct the hearing. Brendan Van Niejenhuis represented the Administration and Standardbred licensee Jeff Barkley Jeff Barkley appeared on his own behalf.
On being advised that Mr. Barkley intended to challenge the positive test result, and on hearing the submissions of counsel for the Administration and of Mr. Barkley, the Commission ordered that:
(a) the hearing was adjourned to a date to be fixed by the Administration, for the purpose of permitting the Administration to obtain and make any necessary documentary disclosure and arrange for any necessary witnesses;
(b) the date for the hearing shall be established by April 15, 2006, failing which the Chair shall be advised that the date has not yet been fixed and the reasons therefor;
(c) Mr. Barkley's license is hereby restored to active status pending the commencement of the hearing;
(d) the Panel as currently constituted is not seized of this matter.
