STANDARDBRED LICENSEE JEFF BARKLEY
Standardbred licensee Jeff Barkley was required to appear before the Ontario Racing Commission pursuant to Rule 6.38.05(iii) as a result of a positive test for cocaine dated May 19, 2006.
On June 13, 2006, a Panel of the Commission consisting of Chair Lynda Tanaka, and Commissioners Bernard Brennan, DVM and Jane Garthson, convened for the appearance. The Administration was represented by Brendan Van Niejenhuis, and Jeff Barkley appeared on his own behalf.
At the outset of the hearing, Jeff Barkley requested an adjournment. On hearing the submissions of Mr. Barkley and of counsel for the Administration, and on being advised that Mr. Barkley intended to tender evidence contrary to the positive test result and to call evidence, the Panel adjourned this appearance on the following terms:
Mr. Barkley shall summons all of the witnesses he intends to call, including Michael LaRose of Addiction Services of Eastern Ontario, an appropriate person from MDS Laboratories, if he intends to tender evidence arising from MDS Laboratories’ analysis, and any other person he intends to call.
Mr. Barkley shall comply with the rules pertaining to disclosure in the Commission’s Rules of Procedure.
The hearing date is established as July 26, 2006 at 10:00 a.m., and is peremptory on Mr. Barkley to proceed that day.
