AND IN THE MATTER IN THE APPEAL OF
STANDARDBRED LICENSEE JEFF BARKLEY
Standardbred licensee Jeff Barkley was required to appear before the Ontario Racing Commission pursuant to Rule 6.38.05(iii) as a result of a positive test for cocaine dated March 10, 2006. Mr. Barkley’s first appearance was held on March 22, 2006, and was adjourned to this date of June 13, 2006, by Order of the Commission (COM SB 003/2006).
On June 13, 2006, a Panel of the Commission consisting of Chair Lynda Tanaka, and Commissioners Bernard Brennan, DVM and Jane Garthson, convened for the continuation. The Administration was represented by Brendan Van Niejenhuis, and Jeff Barkley appeared on his own behalf.
On reading Exhibit #1, filed, and on being advised that Mr. Barkley no longer contested the positive test, and on being advised that the Administration and Mr. Barkley proposed a joint submission on penalty, the Panel accepted the joint submission and ordered that:
- Mr. Barkley’s licence is fully suspended for a period of five (5) months, commencing June 13, 2006 and ending November 13, 2006.
- Mr. Barkley shall continue to attend for counseling and/or treatment at Addiction Services of Eastern Ontario during the currency of this suspension.
