IN THE MATTER OF THE NOTICE OF PROPOSED ORDER TO REFUSE THE APPLICATION OF STEVEN BRAGG FOR RENEWAL OF HIS LICENCE
Thoroughbred Licensee Steven Bragg (108006) requested a hearing before the Ontario Racing Commission into the Director’s Notice of Proposed Order dated May 3, 2004 to refuse Mr. Bragg’s application to renew his licence as an association official, i.e. as a Clocker.
On September 8 and November 8, 2004 and on January 18 and 19, 2005, Chair Tanaka and Commissioners Garthson and Gorman of the Ontario Racing Commission convened to hold the hearing, which was also scheduled to continue on January 20, 2004.
Simon Van Duffelen represented Mr. Bragg and Tim Snell represented the Administration.
On January 19, 2004, during the course of the hearing and after Investigator Rick Grant gave part of his anticipated testimony on behalf of the Administration on September 8, 2004, Mr. Bragg withdrew his request for a Commission Hearing in respect of this Proposed Order.
THEREFORE TAKE NOTICE that, pursuant to the Racing Commission Act, 2000, (“the Act”) the Director orders that Mr. Bragg’s application to renew his licence is hereby refused.
Furthermore, the Commission Hearing continued on January 19, 2004 after notice had been given to Mr. Van Duffelen of the continuation of the hearing. The Commission heard testimony by witnesses summonsed to appear before the Commission on Mr. Bragg’s behalf, that they had been informed that they would not be paid witness attendance money as required by the Statutory Powers Procedure Act. The Administration applied for and the Commission granted the Admistration’s request for a direction that, in the event that Mr. Bragg should ever reapply for a Commission licence after the expiry of the minimum two-year prohibition period in Section 26 of the Act, and in addition to and without prejudice to the Director’s powers to review and reject applications applying the provisions of subsection 26(3) of the Act, Mr. Bragg’s licence will remain indefinitely suspended until such time as he pays in full the amount of the witness attendance money that is then owed in respect of all witnesses who attended the hearing in response to summonses issued on his behalf.
