AND IN THE MATTER OF THOROUGHBRED TRAINER SAMUEL QUARANTA and OWNER/GROOM JOHN QUARANTA
Trainer Samuel Quaranta and Owner/Groom John Quaranta brought a motion on Monday, April 25, 2005 for an adjournment of this appeal from Ruling TB 115/04.
The Ontario Racing Commission Panel consisting of the Chair Lynda Tanaka, Commissioners Dave Gorman and George Kelly convened to hear the matter. Counsel Brendan Niejenhuis represented the Administration and agent Eugene Trasewick represented the appellants.
On hearing the submissions of counsel and the evidence of Steward Russell Fernandes, the Panel ordered that this matter is adjourned and to be continued on Friday, May 6, 2005, peremptory upon Samuel Quaranta and John Quaranta to proceed on that day. The Panel further ordered that the stay of penalty against Samuel Quaranta granted by Ruling TB 252/04 by order of the Supervisor of Thoroughbred Racing is hereby lifted to the extent that Mr. Quaranta's licence as a trainer is hereby suspended pending further order by the Commission on the resumption of the hearing. Mr. Quaranta shall not be permitted on the backstretch pending further order by the Commission on the resumption of the hearing. The Panel further ordered that Mr. Trasewick, agent for the Appellants Samuel and John Quaranta, shall arrange to serve all witnesses whom he intends to call with summonses to ensure their attendance at the continuation date, and that Mr. Trasewick shall advise the Administration's counsel if he intends to call any witnesses in addition to John Quaranta and Nicholas Luca.
