AND IN THE MATTER OF WILLIAM ROBINSON
Whereas William Robinson (53999) applied for judicial review of the penalty imposed by a panel of the Ontario Racing Commission (Ruling COM SB 18/2000), dated September 6, 2002, which imposed a fine of $50,000 and a full suspension of 10 months, less the period for which Mr. Robinson had been suspended, leaving approximately 6 months to be served with respect to violations of Rules 9.0(b), 26.02 and 26.02.1 of the Rules of Standardbred Racing when ARTISTIC tested positive for the Class III drug phenylpropanolamine, a metabolite of ephedrine, after Race 8 on February 26, 2000;
And whereas the Ontario Superior Court of Justice (Divisional Court) dismissed Mr. Robinson’s application for judicial review in its Reasons for Decision, released on April 16, 2004 (Court File 629/02), with costs to the Ontario Racing Commission;
And whereas Mr. Robinson had applied for judicial review of the following Rulings
a) Ruling Number SB 157/2003 dated August 5, 2003 and issued by the Executive Director in which a suspension of 6 months and a fine of $5,000 was imposed on Mr. Robinson for failure to comply with Rules 6.47.1(a), (b) and (c) of the Rules of Standardbred Racing,
b) Ruling Number SB 168/2003 dated August 5, 2003 and issued by the Director of Racing in which a fine of $2,000 was imposed on Mr. Robinson for failure to comply with Rules 3.09.1 (c) and (f) of the Rules of Standardbred Racing;
And whereas Mr. Robinson had appealed Judges’ Ruling SB30268, dated December 20, 2003 which imposed a fine of $100,000 and a suspension of 5 years on Mr. Robinson for violations of Rules 22.38 and 1.09 of the Rules of Standardbred Racing for a TCO2 reading of 37.7 mmol of a sample of FLIGHT PLAN at Mohawk on November 8, 2003;
And whereas Mr. Robinson has: (i) decided and agreed not to apply for leave to appeal the decision of the Divisional Court and to pay costs of $5,000 to the Ontario Racing Commission (Court File 692/02), (ii) agreed to withdraw his application for judicial review related to Ruling Number SB 157/2003 and Ruling Number SB 168/2000, and (iii) has withdrawn his appeal of Judges’ Ruling SB30268;
Now therefore take notice that Mr. Robinson shall:
serve a suspension of 24 months commencing April 20, 2004 and ending April 19, 2006 and pay a fine of $70,000 with respect to Judges’ Ruling SB30268;
serve a suspension of 6 months and 1 week commencing January 13, 2006 and ending July 19, 2006 and pay a fine of $50,000 with respect to Ruling Number COM SB 18/2002;
serve a suspension of 6 months commencing January 20, 2006 and ending July 19, 2006 and pay a fine of $5,000 with respect to Ruling Number SB 157/2003 and Ruling SB 168/2000.
