Standardbred Owner/Driver/Trainer Garry Macdonald (358267) appealed the unanimous decision of the Ontario Racing Industry Board of Appeal of November 13, 2003, disallowing his appeal of Judges' Ruling Number SB 29611, wherein he was fined $200.00 for violation of Rule 22.22 of the Rules of Standardbred Racing while driving the horse FITZWILLIAM in the 5th race at Elmira Raceway on July 4, 2003.
On February 3, 2004, Chair Lynda Tanaka, Commissioners Bernard Brennan, DVM, and Patricia Bullock of the Ontario Racing Commission convened to hear the appeal.
No one appeared on behalf of Mr. MacDonald. Tim Snell appeared on behalf of the Administration.
Upon hearing the evidence of Bill Hicks, upon reading the exhibits and upon hearing submissions, the Ontario Racing Commission dismissed the appeal.
