Emilio Davison was suspended August 23, 2003, by Ruling TB 322/2003, for failing to comply with Condition 4 set forth in Ruling Number COM TB 9/2002.
On March 26, 2004, Chair Lynda Tanaka convened to hear Mr. Davison's request for reinstatement of his licence.
Emilio Davison appeared on his own behalf and Don Bourgeois appeared on behalf of the Administration.
On hearing the evidence of Emilio Davison and John Whitson, on reading the exhibits filed and on hearing submissions, the Ontario Racing Commission ordered that Mr. Davison's licence be reinstated subject to the following conditions:
Mr. Davison shall continue with his rehabilitation programs through Woodbine's Employment Assistance Program and the Columbus Centre's A.A.D.A program.
Mr. Davison shall provide or cause to be provided to the Director of Racing on a monthly basis written reports of his progress in these programs.
Mr. Davison shall present himself for testing to the ORC drug-testing unit each time it is at a track where he is working.
Mr. Davison shall provide for testing purposes, a sample to a laboratory approved by the Director of Racing, at his expense, when directed to do so by the Supervisor, Thoroughbred Racing.
Mr. Davison shall abstain from all non-prescription drugs.
Failure to fulfil any of the above conditions will result in the immediate suspension of his licence.
