IN THE MATTER OF THE RACING COMMISSION ACT, S.O. 2000, c.20;
AND IN THE MATTER OF THE APPEAL OF
THOROUGHBRED OWNER/TRAINER DARYL EZRA
Thoroughbred Owner/Trainer Daryl Ezra (100170) appealed the decision of the Ontario Racing Industry Board of Appeal of October 9, 2003, disallowing his appeal of the Stewards’ decision not to disqualify the horse GLITTER CAT from first position and place it second behind the horse RED DRAGON for alleged interference caused to RED DRAGON during the third race at Fort Erie Racetrack on August 25, 2003.
On March 11, 2004, Vice-Chair Larry Todd, Commissioners Patricia Bullock and Brenda Walker of the Ontario Racing Commission, convened to hear the appeal.
Daryl Ezra appeared on his own behalf and Tim Snell appeared on behalf of the Administration.
Upon hearing the evidence of Richard Grubb, Neil Poznansky and Daryl Ezra, upon reading the exhibits, reviewing the evidence and upon hearing the submissions of the parties, the Ontario Racing Commission dismissed the appeal.
The reasons for decision form part of the transcript of the hearing.
DATED this 11th day of March 2004.
