Jockey Jonathan Jones (101516) appealed Stewards Ruling TB 121/2004 in which he was found in violation of Rules 11.07, 11.09.1 and 11.09.3 of the Rules of Thoroughbred Racing and suspended for three racing days for coming in with his horse INTRUSIVE LAD and interfering with the horse EL GRAN JESSIE in the vicinity of the ½ mile pole during the running of the 2nd race at Woodbine Racetrack on June 5, 2004. INTRUSIVE LAD was disqualified from 2nd position and placed 5th.
On July 29, 2004, the Thoroughbred Division of the Ontario Racing Industry Board of Appeal heard and dismissed this appeal. Mr. Jones requested a hearing before the Ontario Racing Commission.
On November 1, 2004, Chair Lynda Tanaka, and Commissioners Bernard Brennan DVM, and David Gorman of the Ontario Racing Commission convened to hear these appeals.
Dan McMahon appeared on behalf of Mr. Jones and Tim Snell appeared on behalf of the Administration.
Upon hearing the evidence of Steward Richard Grubb, Jockey Jim McAleney, and Mr. Jones, and upon viewing the race tapes, the evidence filed and upon hearing the submissions of the Parties, the Ontario Racing Commission dismissed this appeal.
Ruling TB 121/2004 with respect to the order of finish is confirmed.
Mr. Jones’ licence is hereby suspended three racing days, November 10, 11 and 12, 2004.
