Standardbred owner, driver and trainer Orlie Coville (533315) appealed Judges’ Ruling Number SB 27818 issued against him on November 28, 2002, wherein he was fined the sum of $1,500 and fully suspended for 60 days for violation of Rules 9.09(b), 26.02 and 26.02.1of the Rules of Standardbred Racing for two positive test results for EPHEDRINE, PHENYLPROPANOLAMINE, PSEUDOEPHEDRINE and NORPSEUDOEPHEDRINE taken from the horse DEBS GIRL which raced in the 3rd race, October 16, 2002 at Rideau Carleton Raceway and the horse WESTERN BLISS which raced in the 7th race, October 23, 2002 at Rideau Carleton Raceway.
On February 27, 2003, Vice-Chair Larry Todd, Commissioner Thomas Deacon and Commissioner Bernard Brennan, DVM, of the Ontario Racing Commission convened to hear the appeal.
Jean-Marc MacKenzie appeared on behalf of Mr. Coville and Don Bourgeois appeared for the Administration.
Upon hearing the testimony of Judge Donald Raymond and Mr. Coville, upon reading the exhibits filed, upon hearing submissions on behalf of the parties, the Ontario Racing Commission dismissed the appeal and ratified the fine of $1,500 and a full suspension of 60 days, the last 30 of which are to be stayed. The suspension is to commence on March 21, 2003.
