RICHARD K. BAKER
Standardbred licensee Richard K. Baker (E01031) requested a hearing pursuant to Ruling Number COM SB 16/2002, dated July 16, 2002.
On September 23 and December 18, 2003, Vice Chair Larry Todd and Commissioners Patricia Bullock and Brenda Walker of the Ontario Racing Commission convened to hear the appeal.
Mr. Baker appeared on his own behalf and Don Bourgeois appeared for the Administration.
Upon hearing the testimony of Jane McDonough, Kent Baker and Richard Baker, upon reading the exhibits and upon hearing the submissions on behalf of the parties, the Ontario Racing Commission ordered that Richard Baker may be licensed as of January 1, 2004 on the following conditions:
- The period of the licence and any renewals shall not exceed 18 months, after which time, Mr. Baker shall appear before the Commission to satisfy the Commission why conditions to his licence are no longer required;
- Mr. Baker shall cause Kent Baker to provide a written report on a quarterly basis to the Administration indicating whether or not Richard Baker continues to be employed by him and to report on his conduct and progress, or lack thereof;
- Mr. Baker shall, at the Administration’s discretion, at least quarterly for six quarters, provide a urine sample for testing purposes;
- Mr. Baker shall enter and complete a substance abuse program(s) provided by Simcoe Outreach Services, or another provider of such programs acceptable to the Administration, for the 18-month period and shall cause the program deliverer to provide to the Administration a quarterly report with respect to attendance and progress;
- A breach of any of these conditions shall result in the immediate revocation of this conditional licence.
