AND IN THE MATTER OF STANDARDBRED OWNER/DRIVER/TRAINER WILLIAM MEGENS
Standardbred Owner/Driver/Trainer William Megens (527093) appealed the severity of penalty imposed by the Judges in Ruling Number SB29559 issued on May 26, 2003, wherein he was fined $1,500 and fully suspended for 120 days for violation of Rule 22.38 of the Rules of Standardbred Racing with respect to MOUNTAIN HURRAH which raced in the 1st race at Mohawk on May 18, 2003.
On September 23, 2003, Larry Todd, Vice Chair, and Commissioners Patricia Bullock and Brenda Walker convened to hear the appeal.
Robert Megens appeared on behalf of William Megens and Don Bourgeois appeared on behalf of the Administration.
On hearing the evidence of William Megens, Tracey Newman, Gary Cahill and Terry Stone, on reading the exhibits and on hearing submissions of the parties, the Ontario Racing Commission varied the penalty to a fine of $1,500 and a full suspension for 90 days. The suspension is to start on September 26, 2003.
