DAVID BOUGHTON
Standardbred owner, driver and trainer David Boughton (E13671) appealed the Judges decision to place the horse EARL OF OPENWOOD from 1st position to 3rd position in accordance with Rule 22.27(c) of the Rules of Standardbred Racing, in the 10th race on September 13, 2003 at Sudbury Downs Raceway.
On October 14, 2003, Chair Lynda Tanaka, Commissioner Brenda Walker and Commissioner Bernard Brennan, DVM of the Ontario Racing Commission convened to hear the appeal.
Mr. Boughton appeared on his own behalf and Don Bourgeois appeared on behalf of the Administration.
Upon hearing the testimony of Judge Gary Keays and Mr. Boughton, upon reading the exhibits filed, and upon hearing submissions on behalf of the parties, the Ontario Racing Commission dismissed the appeal.
The Commission gave oral reasons for its decision, which are part of the transcript.
