Thoroughbred owner Carmine Sorella appealed Stewards’ Ruling TB 154/2003 declaring the claim of FRESH THUNDER from the 10^th^ race on May 2, 2003 at Woodbine void in accordance with Rule 12.01.1. The horse FRESH THUNDER was claimed by Dare 2 Dream Racing Stable and one of the partners (Adriano Sorella) had been previously suspended thereby making him ineligible to participate in Ontario. The horse FRESH THUNDER was returned to the previous owner, Colebrook Farms.
On June 12, 2003, Chair Stanley Sadinsky, Q.C, Commissioners Brenda Walker and Dr. Bernard Brennan, DVM, of the Ontario Racing Commission, convened to hear the appeal.
Carmine Sorella appeared on behalf of Dare 2 Dream Racing Stable, John Brnjas appeared on behalf of Colebrook Farms and Don Bourgeois appeared for the Administration.
Upon hearing the testimony of Adriano Sorella, upon reading the exhibits filed and upon hearing submissions on behalf of the parties, the Ontario Racing Commission dismissed the appeal. The horse FRESH THUNDER is entitled to be entered and raced by Colebrook Farms.
The Commission gave oral reasons for its decision, which are part of the transcript.
