IN THE MATTER OF THE RACING COMMISSION ACT 2000, S.O. 2000, c.20;
AND IN THE MATTER OF STANDARDBRED LICENSEE LISA VANDERWAL
Standardbred owner and trainer Lisa Vanderwal was to appear before a panel of the Ontario Racing Commission with respect to the reinstatement of her licence as an owner and trainer. Ms. Vanderwal had been fully suspended, fined and placed on probation by the judges at Rideau Carleton Raceway as a result of a violation of Rules 26.02 and 26.02.1 of the Rules of Standardbred Racing arising from a positive test from the horse LOLITA BECQUET that raced at Rideau Carleton Raceway in the 7th race on November 18, 2001. The ruling of the judges is set out in Judges’ Ruling SB 25046, dated December 7, 2001.
On April 2, 2002, Vice Chair Herbert Bryant and Commissioners Thomas Deacon and Ernest Nock of the Ontario Racing Commission convened to hold the hearing.
Ms. Vanderwal appeared on her own behalf and Counsel Don Bourgeois appeared for the Administration.
Upon hearing the testimony of William Fines, Supervisor of Standardbred Racing and of Ms. Vanderwal, upon reading the exhibits filed, upon hearing submissions on behalf of the parties, the Ontario Racing Commission imposed the following terms on Ms. Vanderwal’s licence with the consent of Ms. Vanderwal: effective April 6, 2002:
Ms. Vanderwal shall at all relevant times when one of her horses is programmed to race be in attendance in the paddock;
Ms. Vanderwal’s stable of racing horses shall be restricted to the four horses that are currently in her stable. If Ms. Vanderwal intends to expand the number of horses in her stable that are eligible to race in Ontario, she shall obtain the prior approval of the Director of Racing to do so;
Ms. Vanderwal shall permit access to the farm and its operations for inspection by enforcement personnel of the Ontario Racing Commission to ensure compliance with the Rules of Standardbred Racing and these terms; and
Ms. Vanderwal shall operate her stable using an “assignment barn” system whereby each groom, assistant trainer and other relevant licensee is assigned specific responsibility for a horse and its care, feeding and racing-related activities once her stable contains more than four horses that are eligible for racing in Ontario.
The terms set out above are in effect until December 5, 2004, the date on which her period of probation imposed by Judges’ Ruling SB 25046 expires.
