Standardbred Owner/Trainer Gale Moen, has properly appealed the Judges’ Ruling Number 20386, issued on November 25, 2001, wherein she was fully suspended for fifteen (15) days (November 30 to December 14, 2001, inclusive) and fined the sum of $1,000.00 for violation of Rules 9.09 (b), 26.02 and 26.02 of the Rules of Standardbred Racing as a result of a positive test for the drug FUROSEMIDE which was taken from the horse “ELEGANT LADY” which raced in the 9th race at Windsor Raceway on August 29, 2001;
On March 20, 2002, Vice Chair Herbert Bryant and Commissioners Thomas Deacon and Pat Bullock of the Ontario Racing Commission convened to hold the hearing.
Counsel Don Bourgeois appeared for the Administration and spoke to a joint submission on penalty with the consent of Ms. Moen’s legal counsel, Jean Mark MacKenzie.
Upon hearing the joint submissions on behalf of the parties, the Ontario Racing Commission varied the penalty to a full suspension of 10 days and a fine of $500.00.
The Commission gave oral reasons for its decision which are part of the transcript.
