Thoroughbred owner and trainer Gordon Cowie appealed Stewards’ Ruling Number 2001-128 issued on August 14, 2001 at Fort Erie suspending his licence for a one calendar year period for violating Rules 15.09.1, 15.09.2 and 16.13(c) of the Rules of Thoroughbred Racing by causing the falsification of the transfer of the ownership on the foal certificate of the thoroughbred SHOW ME SOME LEG. SHOW ME SOME LEG was placed on the Stewards’ List and made ineligible to enter in Ontario pending the outcome of the appeal by Stewards’ Ruling 2001-133, dated August 19, 2001 at Fort Erie.
On November 14, 2001 and April 17, 2002, Vice-Chair Herbert Bryant and Commissioners Thomas Deacon and Ernest Nock of the Ontario Racing Commission convened to hear the appeal.
Counsel Dan McMahon appeared on behalf of Gordon Cowie and Counsel Don Bourgeois appeared for the Administration.
Upon hearing the testimony of Steward James Nemett, Richard Silver, Christine Everingham, Ralph Biamonte, Gordon Cowie and Donna Michlik, upon reading the exhibits filed and upon hearing submissions on behalf of the parties, the Ontario Racing Commission dismissed the appeal and upheld the ruling of the stewards. The suspension of one year was immediately effective. The horse SHOW ME SOME LEG may be removed from the Stewards’ List at the discretion of the Stewards.
