AND IN THE MATTER OF THE APPEAL OF
STANDARDBRED LICENSEE RAY MCLEAN JR.
RULING
The licence of Ray McLean Jr., licence number H16876, was suspended pursuant to Rule 6.38(e)(iii) of the Rules of Standardbred Racing pending his appearance before the Ontario Racing Commission after testing positive for THC CARBOXYLIC ACID.
On April 22nd, 2002, Chair Stan Sadinsky, Commissioner Patricia Bullock and Commissioner Dr. Bruce Duncan, D.V.M. convened to hear the matter.
Mr. McLean appeared on his own behalf and Counsel Don Bourgeois appeared for the Administration.
On hearing the matter the panel of the Ontario Racing Commission reserved their decision pending receipt of further information
TAKE NOTICE that Ray McLean Jr. standardbred licence is hereby reinstated with the following conditions:
He must enroll in a drug and rehabilitation program;
He must provide confirmation of his attendance at a rehabilitation program in writing to the, Director of Racing;
The drug rehabilitation program he attends must provide details of his progress every 30 days to the, Director of Racing;
He must present himself for testing to the ORC drug testing unit each time the unit is at a track where he is racing;
He must provide a written undertaking to abstain from non-prescription drugs
A failure to fulfill any of these conditions will result in an immediate suspension of his licence.
