AND IN THE MATTER OF THE APPEAL OF
STANDARDBRED LICENSEE SANDY JONES
RULING
The licence of driver Sandy Jones was suspended pursuant to Rule 6.38(e)(iii) of the Rules of Standardbred Racing pending his appearance before the Ontario Racing Commission after testing positive for COCAINE METABOLITE BENZOYLECGONINE and the CARBOXYLIC ACID.
On January 23, 2002, Vice-Chair Herbert Bryant, Commissioner Patricia Bullock and Commissioner Thomas Deacon convened to here the matter.
Mr. Jones appeared on his own behalf and Counsel Don Bourgeois appeared for the Administration.
Upon reading the exhibits filed and upon hearing the evidence of Mr. Jones and trainer J. Marchman and the submissions of the parties, the Ontario Racing Commission determined that it was premature to reinstate the driver’s licence. The driver’s licence remains suspended (including a prohibition from any activity at a licensed race-track that involves warming-up, exercising, parading or training horses) until the Administration is satisfied that Mr. Jones has completed a rehabilitation program and demonstrated that he has adequately dealt with his addiction problem. Mr. Jones’ licence as an owner/trainer is not suspended.
The Commission gave oral reasons for its decision which form part of the transcript.
