AND IN THE MATTER OF STANDARDBRED LICENSEE ANN RUSSELL
Standardbred Trainer Ann Russell properly appealed the Judges’ Ruling Number SB 26105, issued on March 15, 2002, wherein she was fully suspended for fifteen (15) days (March 9 to March 23, 2002, inclusive) and fined the sum of $1,000.00 for violation of Rules 9.09 (b), 26.02 and 26.02.1 of the Rules of Standardbred Racing as a result of a positive test for the Class 4 drug NAPROXEN which was taken from the horse “KURT” which raced in the 2nd race at Windsor Raceway on February 23, 2002;
On May 24, 2002, Vice Chair Herbert Bryant and Commissioners Thomas Deacon and Ernie Nock of the Ontario Racing Commission convened to hold the hearing.
Ann Russell appeared on her own behalf and Counsel Don Bourgeois appeared for the Administration.
On hearing the evidence of Judge Paul Harrison, Jennifer Baverman and Ann Russell and on reading the exhibits filed and on hearing the submissions of the parties, the panel dismissed the appeal but reduced the fine to $500.00. Ms. Russell is suspended for 15 days (May 28, to June 11, 2002 inclusive);
