Standardbred licensee Philippe Laframboise applied for judicial review of Ontario Racing Commission Ruling COM SB 12/2002, June 7, 2002. Ruling COM SB 12/2002, by majority, dismissed his appeal of Judges’ Ruling Number SB 26672 issued against him on April 19, 2002, wherein he was suspended from driving for 90 days for violation of Rule 22.10 of the Rules of Standardbred Racing, while driving the horse LATCKA in the 4th race at Mohawk Raceway on April 16, 2002, with design to prevent it winning the race.
Mr. Laframboise brought a motion to stay Ruling COM SB 12/2002 pending the disposition of his application for judicial review. The motion for a stay was heard by the Superior Court of Justice (Divisional Court) on June 20, 2002, and the stay was denied.
Mr. Laframboise’s suspension as a driver shall be deemed to have commenced as of June 8, 2002, and shall continue to September 5, 2002.
