IN THE MATTER OF THE RACING COMMISSION ACT 2000, S.O. 2000, c.20;
AND IN THE MATTER OF STANDARDBRED LICENSEE PAUL D. CLARK
Standardbred licensee Paul Clark requested a hearing before the Ontario Racing Commission for the reinstatement of his licence pursuant to Rule 6.38(e)(i) of the Rules of Standardbred Racing.
On June 14, 2002, Chair Stanley Sadinsky, Q.C., and Commissioners Patricia Bullock and Ernest Nock of the Ontario Racing Commission convened to hold the hearing.
Mr. Clark appeared on his own behalf and Counsel Don Bourgeois appeared for the Administration.
Upon hearing from the parties, upon reading the exhibits filed and upon hearing submissions on behalf of the parties, the Ontario Racing Commission decided that:
a) Mr. Clark’s licence as a trainer remains suspended for a further 3 months,
b) Mr. Clark’s licence as an owner is reinstated but he is prohibited during that 3 month period from training any horses owned or leased by him,
c) Mr. Clark’s licence as an owner and licence as a trainer are subject to probation for 9 months,
d) Mr. Clark shall present himself for testing to the ORC drug testing unit each time the unit is at a track where he is present
