Robert Bodkin, Jr. appeared before a panel of the Ontario Racing Commission on October 22, 2002, in accordance with Rule 6.38(e) (iii) of the Rules of Standardbred Racing.
Chair Stanley Sadinsky, Q.C. and Commissioner Ernest Nock convened to hear the matter.
Robert Bodkin, Jr. appeared on his own behalf and Counsel Don Bourgeois appeared on behalf of the Administration.
On hearing the evidence of Mr. Bodkin, on reading the exhibits filed and on hearing submissions, the Ontario Racing Commission continued the suspension of Mr. Bodkin’s licence. His licence may be reinstated after he provides proof satisfactory to the Administration that he has successfully completed the treatment program in which he is currently enrolled, has forwarded the assessment report from that treatment program to the Administration and has completed any other treatment program that may be recommended in that assessment report. Upon reinstatement, Mr. Bodkin’s licence shall be subject to the following conditions:
He shall present himself for testing to the ORC drug testing unit each time it is at a track where he is working;
He shall abstain from the use of all controlled substances, other than prescription medication in accordance with the prescription, and provide a written undertaking to do so; and
Failure to fulfill any of the above conditions will result in immediate suspension of his licence.
The reasons for decision were provided orally and form part of the transcript.
