THE ONTARIO RACING COMMISSION
STANDARDBRED RULING
The Judges, in Standardbred Ruling SB 26968, July 6, 2002, placed PLEASE REMEMBER ME 7th for causing interference and violating Rule 22.09 of the Rules 0of Standardbred Racing on June 28, 2002 at Quinte Exhibition in the 9th race. Trevor Henry appealed the Ruling to the Ontario Racing Industry Board of Appeal. The Board of Appeal ruled on August 12, 2002 that the horse PLEASE REMEMBER ME did not cause interference and did not violate Rule 22.09. The Board of Appeal also ordered that Trevor Henry be compensated by the Administration for his attendance in the amount of $150.00. The Administration appealed from the order to compensate Mr. Henry.
On September 5, 2002, Chair Stanley Sadinsky, Q.C. and Commissioners Patricia Bullock and Bernard Brennan, DVM of the Ontario Racing Commission convened to hear the appeal.
Counsel Don Bourgeois appeared for the Administration. Nobody appeared on behalf of Mr. Henry or the Ontario Racing Industry Board of Appeal.
Upon reading the exhibits filed and upon hearing submissions on behalf of the Administration, the Ontario Racing Commission allowed the appeal. The order of the Board of Appeal to compensate is overturned.
The Commission gave oral reasons for its decision which are part of the transcript.
