AND IN THE MATTER OF STANDARDBRED OWNER AND TRAINER PETER POULOS
Standardbred owner and trainer Peter Poulos (M08963) appealed Judges Ruling Number SB 25060, issued on June 9, 2002, wherein he was fully suspended for one year and fined $5,000 for violation of Rules 9.09(b), 26.02 and 26.02.1 of the Rules of Standardbred Racing as a result of positive tests for caffeine, theophylline, theobromine and 1.7 dimethyzanthine of official samples taken from the horse KALEN EXPRESS which raced in the 12th race on May 16, 2002 and the 1st race on May 23, 2002 at Rideau Carleton Raceway.
On November 1, 2002, Chair Stanley Sadinksy, Q.C. and Commissioners Patricia Bullock and Dr. Bernard Brennan, DVM of the Ontario Racing Commission convened to hear the appeal. Counsel Mark Lazarovitz appeared on behalf of Mr. Poulos, and Counsel Don Bourgeois appeared for the Administration.
Upon hearing the evidence of Judge Donald Raymond, Tim Thomas, Peter Poulos and Maria Poulos, upon reading the exhibits filed and hearing submissions, the Ontario Racing Commission dismissed the appeal but varied the penalty. The Commission imposed a suspension of one year of the trainer’s licence and a fine of $5,000.
The Commission gave oral reasons for its decision which form part of the transcript.
By agreement of counsel, the suspension of the trainer’s licence runs from November 4, 2002 to November 3, 2003. The $5,000 fine is payable as follows:
November 15, 2002 - $1,250
December 15, 2002 - $1,250
January 15, 2003 - $1,250
February 15, 2003 - $1,250
