Standardbred Driver/Trainer Robert Robinson appealed SB Ruling issued on November 7, 2002 where, in accordance with Rule 22.09 of the Rules of Standardbred Racing, the Judges placed the horse TERRA COTTA BYE 4^th from 3^rd in the 7^th Race on November 7, 2002 at Rideau Carleton.

Chair Stanley Sadinsky, Q.C., Vice Chair Larry Todd and Commissioner Ernest Nock convened to hear the appeal on November 12, 2002.

Counsel Jean Marc Mackenzie appeared on behalf of Mr. Robinson and Counsel Don Bourgeois appeared on behalf of the Administration.

On hearing the evidence of Judge Donald Raymond, Tom O’Dwyer, Richard McNeil and Robert Robinson, on reading the exhibits filed, and on hearing the submissions on behalf of the parties, the ORC panel dismissed the appeal by a majority.

The Commission provided oral reasons, which form part of the transcript, for both the majority and the minority decision.
