Standardbred Owner/Driver/Trainer Gerard Belanger (V43314) appealed SB Ruling 26715, August 2, 2002, wherein he was fined the sum of $5,000 and fully suspended for one year by the Judges for violation of Rule 9.09(b) of the Rules of Standardbred Racing for positive test result for FUROSEMIDE on the horse LAST TO FIRST in the 11th Race at Sudbury Downs Raceway on April 6, 2002.
Chair Stanley Sadinsky, Q.C., Vice-Chair Larry Todd and Commissioner Thomas Deacon convened on November 15, 2002 to hear the appeal.
Counsel Edmond Paquette appeared on behalf of Mr. Belanger and Counsel Don Bourgeois appeared on behalf of the Administration.
Upon reading the exhibits filed as evidence and upon hearing submissions of the parties, the Commission dismissed the appeal.
The Commission gave oral reasons for its decision which form part of the transcript.
By agreement of counsel, the suspension is to begin on December 9, 2002, and end on December 8, 2003.
