RULING
Standardbred Licensee David Boughton appealed a decision of the Standardbred Industry Board of Appeal, dated October 8, 2002, wherein the panel upheld Ruling Number SB 25846. Pursuant to SB Ruling 25846, David Boughton was suspended from driving for three racing days (August 8-10, 2002) for a violation of Rule 22.05(a) while driving BARNEY BAREN during the 3rd race at Georgian Downs Raceway on July 23, 2002. In addition, BARNEY BAREN was placed from 1st place to 5th.
On November 19, 2002, ORC Vice-Chair Larry Todd convened to consider the matter, along with Commissioners Ernest Nock and Bernard Brennan, DVM.
David Boughton appeared on his own behalf and Joanne Mitchell appeared on behalf of the ORC Administration.
On hearing the evidence of John Kovacs, ORC Judge Neil McCoag and David Boughton, on reading the exhibits filed, and on hearing the submissions from the parties, the ORC panel allowed the appeal. The panel also restored the original order of finish in their decision. The order of finish is now as follows:
