RULING
Thoroughbred Owner/Trainer Tom Marino appealed a Ruling of the Thoroughbred Industry Appeal Board wherein it upheld the decision of the Stewards not to disqualify the horse BARBELLA from first position and place it behind the horse MON AMI AMY for alleged interference during the 1st race of June 2, 2002, at Woodbine Racetrack.
On July 31, 2002, Chair Stanley Sadinsky, Q.C. convened to consider the appeal, along with Commissioners Patricia Bullock and Ernest Nock.
Counsel Dan McMahon appeared on behalf of Tom Marino. Counsel Joanne Mitchell appeared on behalf of the ORC Administration and Counsel Harvey Swartz appeared on behalf of Jennifer and William Edwards.
On hearing the testimony of Steward Richard Grubb, Jockey Laurie Gulas, Jockey Slade Callaghan, Tom Marino, and Jennifer Edwards, on reading the exhibits filed and on hearing the submissions on behalf of the parties, the panel dismissed the appeal.
