THOROUGHBRED RULING
Emilio Davison appeared before a panel of the Ontario Racing Commission on August 29, 2002 in accordance with Thoroughbred Rule 15.26.3 (c).
Chair Stanley Sadinsky QC presided over the matter.
Emilio Davison appeared on his own behalf and Counsel Joanne Mitchell appeared on behalf of the ORC Administration.
On hearing the evidence of Emilio Davison, on reading the exhibits filed and on hearing the recommendations from the Administration, the ORC Chair reinstated the licence of Emilio Davison with the following conditions:
He must complete his current rehabilitation program through the “Employee Assistance Program” at Woodbine and complete any further rehabilitation its counselors recommend;
He must provide updated reports of his progress at the rehabilitation program every 14 days;
On his return to racing, he must provide a weekly urine sample for 6 consecutive weeks at his own expense to a laboratory approved by the Commission. The results of the tests must be forwarded to the Director of Racing;
He must present himself for testing to the ORC drug testing unit each time it is at a track where Mr. Davison is working;
He must abstain from all non-prescription drugs and provide a written undertaking to do so;
Failure to fulfill any of the above conditions will result in immediate suspension.
The reinstatement of Mr. Davison is effective immediately.
