RULING
Thoroughbred licensee Gary Boulanger appealed the Ontario Racing Industry Board of Appeal’s October 26, 2000 denial of his appeal of the Stewards’ Ruling 2000-256, dated September 16, 2000, suspending him for three days for misuse of his whip in the third race at Woodbine on September 14, 2000.
On June 20, 2001, Vice-Chair Herbert Bryant, Commissioner Ernest Nock and Commissioner Bruce Duncan, DVM, of the Ontario Racing Commission convened to hear the appeal.
Dan McMahon appeared on behalf of Gary Boulanger and Counsel Don Bourgeois appeared for the Administration.
Upon hearing the testimony of Steward Nelson Ham, Jockey Gary Boulanger, Trainer Will Gracey and Irwin Driedger, upon reading the exhibits filed, upon hearing submissions on behalf of the parties, the Ontario Racing Commission allowed the appeal.
