STANDARDBRED LICENSEE CARL ALLEN
Standardbred Licensee Carl Allen appealed Judges’ Ruling SB25342, dated September 11, 2001, wherein the horse CR EXCALIBUR finished 3rd and was placed 4th for a violation of Rule 22.27(c) of the Rules of Standardbred Racing for failure to lose ground on a break during the 1st race at Mohawk Raceway on September 11, 2001.
On September 13, 2001, Vice Chair Herb Bryant, Commissioner Thomas Deacon and Commissioner Ernest Nock of the Ontario Racing Commission convened to hear the appeal.
Jean Marc MacKenzie appeared on behalf of Mr. Allen and Counsel Don Bourgeois appeared for the Administration.
Upon hearing the testimony of Judge Jim Thatcher and Carl Allen, upon reading the exhibits filed, upon hearing submissions on behalf of the parties, the Ontario Racing Commission upheld the appeal.
The Commission gave oral reasons for its decision which are part of the transcript.
