AND IN THE MATTER OF THE APPEAL OF
STANDARDBRED OWNER/DRIVER/TRAINER DOUGLAS WALTERS
Douglas Walters, Standardbred owner, driver and trainer appealed Judges’ Ruling SB24441 issued against him on May 14, 2001, wherein he was fully suspended for 180 days and fined the sum of $2,000 for violation of Rules 9.09(b), 26.02 and 26.02.1 of the Rules of Standardbred Racing as a result of two positive tests for the Class 3 drug METAPROTERENOL, taken from the horse LITTLE MS CROMBIE, which raced in the 11th race at Barrie Raceway on April 21, 2001, and the 11th race at Barrie Raceway on April 28, 2001.
On September 25, 2001, Vice-Chair Herb Bryant, Commissioner Dr. Bruce Duncan, DVM and Commissioner Patricia Bullock of the Ontario Racing Commission convened to hear the appeal.
Douglas Walters and Donna Manning appeared on Mr. Walters’ behalf and Counsel Don Bourgeois appeared for the Administration.
Upon hearing the testimony of Judge Gary Cahill, Investigator Troy Moffatt and Douglas Walters, upon reading the exhibits filed, upon hearing submissions on behalf of the parties, the Ontario Racing Commission dismissed the appeal. The panel upheld the full suspension for 180 days but varied the fine from $2,000 to $1,500.
The Commission gave oral reasons for its decision which are part of the transcript.
The full suspension shall be for the period October 31, 2001 to April 28, 2002, inclusive. The fine of $1,500 shall be paid on or before April 28, 2002.
