ROBERT J. BODKIN, JR.
RULING
Robert Bodkin, Jr., Licence Number V55896, appealed SB Ruling 24709 wherein he was fully suspended for thirty (30) days (May 1, 2001 to May 30, 2001 inclusive) and fined the sum of $1,000 for violating Standardbred Rules 10.01(a) and (b) for having possession of needles and injectibles at Sudbury Downs Raceway on April 25, 2001.
Chair Stanley Sadinsky Q.C. convened to consider the appeal, along with Commissioners Thomas Deacon and Ernest Nock.
Robert Bodkin, Sr. appeared for Robert Bodkin, Jr. and Counsel Joanne Mitchell appeared for the Administration.
On hearing the testimony of Constable Dan Caesar, ORC Judge Pat Webb, ORC Judge Todd Guthrie, Robert Bodkin, Sr. and Robert Bodkin, Jr., on reading the exhibits filed, and on hearing the submissions of the parties, the panel dismissed the appeal. The penalty of a 30-day full suspension and $1,000 fine issued in SB Ruling 24709 was upheld.
The panel further directed that the parties, through agreement, may determine the commencement of suspension. Failing agreement between the parties, the matter may be remitted to the panel to determine the commencement of penalty.
