RULING
Standardbred driver/trainer Sandy Jones appealed a decision of the Standardbred Industry Appeal Board dated November 9, 2001 wherein the panel upheld SB Ruling 25412. Pursuant to SB Ruling 25412, Sandy Jones was suspended from driving for five days, September 25-29, 2001 inclusive, for a violation of SB Rules 6.20 and 22.22 for using his whip in an indiscriminate manner while driving "RUN CARAIBE" in the 11th race of September 14, 2001 at Rideau Carleton Raceway.
On December 17, 2001, ORC Chair Stanley Sadinsky Q.C. and Commissioners Patricia Bullock and Ernest Nock convened to consider the appeal.
Sandy Jones appeared on his own behalf and Counsel Joanne Mitchell appeared for the Administration.
On hearing the evidence of ORC Judge John Campbell and Sandy Jones, on reading the exhibits filed and on hearing the submissions of the parties, the ORC panel dismissed the appeal.
The reasons for decision were given orally and form part of the transcript.
