RULING
Thoroughbred trainer Kathy Patton appealed the Stewards’ decision to deny her protest of the claim of horse “GRAY LIMOUSINE” from the 9th race on May 25, 2001 at Woodbine Racetrack.
On May 30, 2001, Vice-Chair Herbert Bryant, Commissioner Thomas Deacon and Commissioner Bruce Duncan, DVM of the Ontario Racing Commission convened to hear the appeal.
Dan McMahon appeared on behalf of Kathy Patton and Counsel Don Bourgeois appeared for the Administration.
Upon hearing the testimony of Steward Nelson Ham, trainer John Mackenzie, owner Woodsworth Dawson and trainer Kathy Patton, upon reading the exhibits filed, upon hearing submissions on behalf of the parties, the Ontario Racing Commission dismissed the appeal of Kathy Patton.
The Commission gave oral reasons for its decision which are part of the transcript.
