THOROUGHBRED JOCKEY GARY BOULANGER
RULING
Jockey Gary Boulanger appealed the decision of the Ontario Thoroughbred Racing Industry Appeal Board dated August 2, 2001, wherein Thoroughbred Ruling 2001-217 was upheld by the panel. Pursuant to TB Ruling 217-2001, Mr. Boulanger was suspended for three racing days, July 8, 11, and 12, 2001, in accordance with TB Rules 11.07, 11.09.1, 11.09.3, 11.09.5 and 11.14, for going out with his mount “WILDERNESS STORM” and interfering with “MUHAYAA’S CROWN” during the stretch run of the 5th race on July 2, 2001, at Woodbine Racetrack. As a result, “WILDERNESS STORM” was disqualified from 2nd position and placed 6th.
On October 17, 2001, Vice Chair Herbert Bryant convened to hear the appeal along with Commissioners Dr. Bruce Duncan and Ernest Nock.
Gary Boulanger appeared on his own behalf and Counsel Joanne Mitchell appeared on behalf of the Administration.
On hearing the testimonies of ORC Steward Richard Grubb and Gary Boulanger, on reviewing the evidence presented and on hearing the submissions from the parties, the ORC panel dismissed the appeal.
On agreement between the parties, Mr. Boulanger’s suspension days are October 21, and October 24-25, 2001.
