JOCKEY EMILE RAMSAMMY
RULING
Jockey Emile Ramsammy was summonsed by the ORC Administration to appear as a witness for the appeal of Jockey Gary Boulanger, which was scheduled to be heard at 10:00 a.m. on October 17, 2001. Mr. Ramsammy failed to appear and give testimony, although he was properly summonsed by the Administration.
An ORC panel consisting of Vice Chair Herbert Bryant, along with Commissioners Dr. Bruce Duncan and Ernest Nock, convened later that day to consider the matter of Mr. Ramsammy’s non-attendance.
Counsel Shale Wagman made submissions on behalf of Mr. Ramsammy and Counsel Joanne Mitchell made submissions on behalf of the Administration.
On reviewing a copy of the summons issued to Emile Ramsammy and the corresponding acknowledgement of service and on hearing the submissions of the parties, the panel imposed a fine in the amount $1,000 to Mr. Ramsammy pursuant to Thoroughbred Rule 24.01(d) for his failure to attend and provide testimony when properly summonsed.
The panel’s Reasons for Decision were delivered orally and form part of the transcript.
