IN THE MATTER OF THE RACING COMMISSION ACT, [S.O. 2000, c. 20](https://www.canlii.org/en/on/laws/stat/so-2000-c-20/latest/so-2000-c-20.html);
AND IN THE MATTER OF AN APPLICATION FOR TELETHEATRES
BY FORT ERIE RACETRACK
On March 15, 2001, Chair Stanley Sadinsky Q.C., Vice-Chair Herbert Bryant and Commissioners Patricia Bullock, Diane Carlton, Tom Deacon, Bruce Duncan and Ernest Nock convened to hear teletheatre licence applications from Fort Erie Racetrack for locations in Welland, Niagara Falls and Grimsby, Ontario.
General Manager Eddie Lynn represented Fort Erie Racetrack. Charles Juravinski and President Richard Jacob represented Flamboro Downs Raceway. Legal Counsel Mike Sherrard represented the Horsemen’s Benevolent and Protective Association and Chief Operating Officer Reed Lawson appeared for the Ontario Harness Horse Association. Manager, Information Services Wendy Hoogeveen and Legal Counsel Joanne Mitchell appeared on behalf of the Administration of the Ontario Racing Commission.
Upon hearing the representations from the parties to the hearing, the Ontario Racing Commission unanimously granted the motion from Flamboro Downs Raceway to adjourn the hearing until April 10th, 2001 to allow for further negotiation among the parties to try and resolve the underlying issues in this case. The Commission also set aside April 11th if required and will proceed with the hearing on April 10, 2001, on a peremptory basis. It was also noted that the panel is not seized with the matter and may be differently constituted on April 10th, 2001 and April 11, 2001.
Oral reasons for this decision were given at the hearing and form part of the transcript.
DATED this 23rd day of March, 2001.
BY ORDER OF THE COMMISSION
